    4030 Public Interest Criterion

    You may have chance to get visa in case you might have submitted false information prior

    PIC 4020 may refuse a visa if the applicant submits a false or misleading document or false or misleading statement regarding the application, or if the Minister is not sure of the applicant’s identity.

    If PIC 4020 is one of the specific visa criteria you applied for, you must meet PIC 4020 to get a visa.

    Visas affected by PIC 4020

    If you apply for one of the following visas, you must meet PIC4020.

    • Certified Transition
    • Visa Business visa
    • Temporary visa
    • Student visa
    • Family visa.

    PIC 4020 requires that you satisfy us of your identity to be granted a visa (where that visa includes PIC 4020 as part of the criteria).
    If we are not satisfied of your identity your visa may be refused.
    This requirement applies to visa applications lodged on or after 22 March 2014 and all visa applications made, but not finally determined before 22 March 2014.

    Non Grant period-
    If your PIC 4020 visa is denied because you did not give your identity, you may not be issued a visa for 10 years (if your visa includes PIC 4020 as part of your criteria).

    Wavier-
    There is no waiver available for the identity requirement or the ten year nongrant period.

    Members of your family unit-
    If your visa is denied because you did not inform us of your identity, the person who listed you as a member of the Family Association will also be rejected. These families will also be denied another visa (if the visa includes PIC 4020 as part of the criteria) for 10 years.

    Visa applicants must not provide false documents or information in materials related to their visa application.

    Your visa application may be denied if you or someone in your family is:

    Providing false documents or information as part of a current visa application

    You have previously provided false or misleading fake documents or information regarding the visa you currently hold 12 months prior to your application.

    Non-grant period
    Your visa may be denied for up to three years if your visa application is denied because you or someone in your household has provided false documents or information that is materially false or misleading.

    Wavier
    If you are considering refusal of your visa because we believe you have provided fake documents or false or misleading information (if this visa includes PIC 4020 as part of its criteria), you will be asked why your visa should be approved. It must be stated… This must be one of the following reasons:

    Emergencies Affecting Australia.
    Justifiable or sympathetic reasons affecting Australian citizens, permanent residents or eligible New Zealand citizens.

    Family member
    If your visa is denied for providing false or misleading or misleading information, your application may also deny the fact that you are a family member. These family members may be denied another visa for three years.

    If we are unable to verify your identity, or if your application contains forged documents or false or misleading information, we will notify you within the specified period and ask for your opinion.

    If your visa application is denied, you may be entitled to a decision by the Court of Administrative Appeal. If your visa application is denied, you will be informed of what review rights you have.

    If denied under PIC 4020, you can apply for a new visa, but subject to the following conditions:

    If you are in or outside Australia and have a visa other than a temporary visa, you can apply for a new visa.

     

    If your visa has been denied for providing false or misleading fake documents or information in the past 3 years and you are applying for a new visa (if your visa includes a PIC 4020 as part of the criteria), you must provide a reason. Why a visa should be issued. These reasons should be:
