Expertise and Specialization

Australian Immigration law is an intricate and highly specialized domain, often leaving Registered Migration Agents (RMAs) ill-equipped and lacking the required experience to provide guidance. A notable disparity between an RMA and an Immigration Lawyer lies in the level of qualification and study undertaken. Migration lawyers undergo a more rigorous training and education process. Their training encompasses a wide range of subjects, including statutory interpretation, legal research and communication, administrative law, and civil procedures. This legal training equips migration lawyers with an advanced and comprehensive skill set, empowering them to handle migration matters with great proficiency.

Migration Amendment Act

The Migration Amendment (Regulation of Migration Agents) Act 2020 was enacted in June 2020 and became effective in March 2021. This legislation amended the Migration Act 1958, exempting Australian legal practitioners with unsupervised practicing certificates from the requirement of registering with the Office of the Migration Agents Registration Authority (OMARA) as migration agents.

A significant difference between an RMA, and an Immigration Lawyer, is the level of qualification and study undertaken. For example, if your case goes to court, our Immigration Lawyers have complete knowledge and experience and thus can provide seamless representation, unlike an RMA.
The level of training and education is clearly more rigorous than that required for agents, not to mention that migration lawyers are held to a higher and more professional standard of conduct through the legal profession. During their study, migration lawyers are trained in subjects such as statutory interpretation, legal research and communication, administrative law and civil procedure. The depth of this legal training equips migration lawyers with a far more advanced and comprehensive skill set which will be used in handling your migration matter.

It is crucial to exercise caution and guard against scams. The GCC, MENA region, and India are home to numerous unregistered migration agents who have unfortunately victimized many individuals. When planning to migrate to Australia, it is imperative to engage a registered migration agent, registered with OMARA or FBP International (Certified Australian Legal Practitioner). Only a select few Australian migration companies in the GCC, MENA region, and India are legally authorized to process Australian visa applications, including F4-MG Private Ltd.

Attention! Failing to use a registered migration agent or an Immigration Law firm such as FBP International or its affiliates can result in deportation within seven days if caught by Australian law enforcement.

Therefore, the in-house Australian immigration lawyers at FBP International have made the decision not to pursue continued registration with OMARA. Consequently, under specific conditions, Australian legal practitioners are legally permitted to provide immigration assistance within the purview of their legal practice without OMARA registration.
